This is a legally binding contract whereas you, the owner of the property and/or assigned designee, as stated in the proposal, fully understands the statements below and consents to all the terms and conditions as outlined. By acceptance of this contract you, the property owner and/or assigned designee agrees to move forward with scheduling work as outlined in the proposal. The work detailed in the quote shall be performed by Timberlane Land Services. Timberlane Land Services is fully insured and all workers are covered by worker"s compensation, property damage, public liability, and complete operation insurance. Acceptance of proposal. The above prices, specifications, and conditions are satisfactory and hereby accepted. Timberlane Land Services is authorized to do the work as specified. Payments are due upon completion.
TERMS AND CONDITIONS OF THE CONTRACT Performance by Timberlane Land Services: Work crews shall arrive at the job site unannounced unless otherwise noted. Timberlane Land Services shall attempt to meet all performance dates, but shall not be liable for damages due to delays from inclement weather or other causes beyond our control. Workmanship: All work will be performed professionally by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly and safely. Unless otherwise directed by owner, Timberlane Land Services will complete all work in accordance to the proposal. Changes to the agreed upon proposal will result in a change order. Change orders will follow the same terms and conditions as the agreed proposal. Any permits required by municipalities are the sole responsibility of the owner and Timberlane Land Services will not be held responsible for obtaining such permits. Insurance: Timberlane Land Services is insured for liability resulting from injury to persons or property, and all its employees are covered by Workers Compensation Insurance. Sub-contractors will be covered under Timberlane Land Services insurance. Ownership: The customer warrants that all trees, plant material and property upon which work is to be performed are either owned by him/her or that permission for the work has been obtained from the owner. Timberlane Land Services is to be held harmless from all claims for damages resulting from the customer"s failure to obtain such permission. Damages: Timberlane Land Services will photograph work area prior to start of work. Pre-existing damages will be documented and the Timberlane Land Services will not be held responsible for pre-existing damages. In the rare event Timberlane Land Service does cause damage to the owner"s property, a reasonable effort will be made to resolve and/or satisfy the damage in a timely manner. Prior to leaving anything less than a 5 star review, the property owner must communicate via email, any and all dissatisfaction. Timberlane Land Services will make every effort to rectify the complaint as our reputation is of the utmost importance. False claims will be handled through the court of law.
Terms of Payment: All accounts are net payable upon completion or receipt of the invoice. A service charge of 1.5% of the original agreed upon amount will be added to accounts not fully paid 30 days subsequent to the invoice date. If outside assistance is used to collect the account, the customer is responsible for all costs associated with the collection, including, but not limited to, attorney fees and court costs. Failure to satisfy payment in full may result in a lien placed on the said property. An initial deposit of 10% is required as approval of the proposal, this deposit is non-refundable. The second draw payment of 25% is due on day of starting the project. Additional draws will be outlined in proposal depending on the size of the project (only applies to projects over $10,000).
